Covenant Details

The restrictive covenant applies collectively to 13 Hermitage Road along with all of the other sites of the odd-numbered properties from 9 to 21 Hermitage Road inclusive.

The restrictive covenant prohibits the construction of more than seven detached houses or bungalows on all of those sites taken as a whole.

This means that, given the current configuration of the sites, you cannot build more than one detached house or bungalow on each site in place of the existing property on that site.

The restrictive covenant is enforceable by the owners of 13 other properties in the neighbourhood (acting either individually or collectively).We are a group of such owners entitled to enforce the restrictive covenant.(Not all of the entitled owners are members of our group, but this does nothing to weaken the rights of those who are members of it.)

The restrictive covenant (which dates from 1957) is registered at the Land Registry, where you will find full details of it.
The restrictive covenant applies regardless of any grant of planning permission.Planning permissions have no effect whatsoever on our rights under the restrictive covenant.

We, as an action group, are totally committed to enforcing the restrictive covenant by all permissible means, including court action if necessary.
